On Thursday, the Supreme Court upheld a lower court’s sentence of four years in jail for Chung Kyung-sim — a former Dongyang University professor and the wife of former Justice Minister Cho Kuk — for fraudulent activity involving college admissions for her daughter and illegitimate investment in a private equity fund. The investigation into her was initiated by former Prosecutor General Yoon Suk-yeol shortly after her husband was nominated to head the Ministry of Justice after serving as a presidential aide in the Blue House. The prosecution indicted Chung on September 6, 2019, the day her husband’s confirmation hearing started. After 29 months of trials, numerous charges of corruption by the Cho family have been affirmed by the top court.

One point of contention was whether a PC obtained by investigators from an instructors’ room at Chung’s university could be used as evidence. The PC contained sensitive files that could back suspicions about credentials for her daughter’s college entrance, including a file of the university president’s seal, which may have been used to create fake certificates about the daughter’s activities at the school. Chung persistently argued against the PC being used as evidence since her first trial. But the court found no legal problem with the PC, as it was managed by the university and was submitted by one of the professor’s assistants. The court also concluded that all her daughter’s intern activities at several universities, including Seoul National University, were “manipulated” in line with the same judgments from lower courts. The ruling will likely affect former justice minister Cho’s separate trials over related charges.

We respect the top court’s ruling. Corruption in the college entrance process damages our society’s core value — justice. The public “frustration and disappointment” pointed out by lower courts reflects that truth. After the highest court’s ruling, Pusan National University must restart the procedure of cancelling the admission of the daughter, who could get admitted to its medical school in 2014 based on fake documents.

After the two lower court rulings against his wife, Cho brought the case to the Supreme Court without any apology. Even after the top court’s ruling, he reiterated his own pain and expressed concerns about a “retrogression of advanced Republic of Korea” if former chief prosecutor Yoon, now presidential candidate for the opposition People Power Party (PPP), wins the March 9 election.

The Cho family must humbly accept their defeat. Otherwise, the nation could be sharply split again. The time is long overdue for the family to do some deep soul-searching.

정경심 유죄 확정...조국 일가 반성하고 사과해야

2년5개월 만에 7대 입시스펙 허위 판단 소모적 국론 분열 사건으로 기록될 것

자녀 입시 부정과 사모펀드 불법 투자 등의 혐의로 기소된 조국 전 법무부 장관 아내 정경심 전 동양대 교수에 대해 대법원이 어제 징역 4년형을 확정했다. 조 전 장관이 법무부 장관에 내정된 직후 윤석열 당시 검찰총장의 지시로 수사가 시작됐다. 검찰은 조 전 장관의 인사청문회 날인 2019년 9월 6일 정 전 교수를 전격 기소했고, 2년5개월 만에 이른바 '조국 일가 비리'에 대한 사법부의 최종 판단이 내려졌다.

상고심의 핵심 쟁점은 동양대 강사휴게실 PC의 증거 능력을 인정하느냐 여부였다. 해당 PC에선 동양대 표창장 위조에 쓰인 '총장님 직인' 파일 등 입시 비리 혐의를 뒷받침하는 파일들이 나왔다. 정 전 교수는 1심부터 줄곧 증거 능력이 없다고 주장했다. 그러나 대법원은 "동양대 측이 PC를 지배·관리해 왔고 동양대 조교가 PC를 자발적으로 제출해 법적 문제가 없다"고 판시했다. 대법원은 또 정 전 교수의 딸 조민씨가 서울대‧동양대‧단국대 등에서 인턴 등의 활동을 했다는 ‘7대 스펙’이 모두 허위라고 판단했다. 1, 2심에 이어 3심도 같은 판단을 한 것이다. 이번 판결은 입시 비리 등으로 따로 1심 재판이 진행 중인 조 전 장관에게도 불리하게 작용할 것으로 보인다.

유죄 판결은 사필귀정이다. 입시 비리는 공동체에 미치는 해악이 크다. 1, 2심 재판부가 "공정한 경쟁을 위해 성실히 노력하는 많은 사람에게 허탈감과 실망감을 안겨줬다" "입시제도 자체의 공정성에 대한 우리 사회의 믿음과 기대를 심각하게 훼손시켰다"고 공개적으로 지적한 그대로다. 최종 판결이 나왔으니 부산대는 허위 스펙을 활용해 2014년 부산대 의전원에 합격한 조민씨에 대한 입학 취소 절차를 신속하게 진행해야 한다.

조 전 장관은 검찰 수사 때는 재판에서 다투겠다고 하더니 1, 2심에서 유죄가 나오자 3심에서 보자며 상고했다. 판결에 승복하지 않은 것은 물론 반성이나 사과 한마디 한 적이 없었다. 이날 대법 판결 후에도 조 전 장관은 "고통스럽다. 선진국 대한민국이 대선 결과 난폭 후진하게 될까 걱정이 크다"며 반성하는 자세를 전혀 보이지 않았다. 김용민 더불어민주당 의원은 "재판운, 판사운이 있다는 말이 사라지는 세상을 만들겠다"며 '사법개혁'을 언급하며 외려 공세를 취했다.

오랜 기간 수사와 재판 등 법적 절차를 거쳐 나온 결론인 만큼 조국 일가와 여권은 상고심 판결에 깨끗이 승복하고 더 이상의 소모적 논쟁 고리를 끊어야 한다. 새로운 출발을 위해 잘못에 대해 인정할 것은 인정하고, 사과할 것은 사과하는 성숙한 자세도 필요하다. 조국 사태로 전 국민이 둘로 쪼개져 수년간 극한 대결을 벌였다. 이번 판결을 조국 사태의 어두운 그림자를 털고, 새롭게 미래로 출발하는 계기로 삼아야 한다.
