A Seoul administrative court issued a temporary stay on the government plan to enforce "vaccine passes" — a proof of two-shot vaccinations or negative PCR test results within 48 hours — when teenagers enter cram schools, study rooms and other outer-school facilities for studying.

The court sided with the parent association which filed the injunction against the health minister after the government mandated vaccine passes in learning facilities from December 6.

The court reached the conclusion that the discriminative move on unvaccinated people infringed on civilian freedom to learn and choose professions and other basic rights.

The Ministry of Health plans to appeal, but until the first trial ruling is delivered, the vaccine pass system cannot be enforced on learning facilities.

Therefore, individual facilities must come up with their own measures to prevent herd infections. The government also must devise alternative measures to its plan to expand the vaccine pass on teenagers aged 18 and under from March 1.

The government must endeavor so as not to invalidate the vaccine pass system, as the court ruling applies only to study locations. But a broader ramification is inevitable if the court comes to the same conclusion in the injunction suits on the enforcement in restaurants and cafes.

The vaccine pass program will be of no use if the court applies the same reasoning on other mass-use facilities.The government must realize the entire quarantine system could crumble.

It should reexamine the quarantine approach to deliberate if it really was not designed for the convenience of the administrator. It must come up with a convincing and scientific approach instead of uniform and political one to draw support from all citizens.

The vaccine pass enforcement on grocery and department stores from January 10 has provoked strong backlash. People cannot understand why they should be restricted in shopping for daily necessities when there is no restraint on unvaccinated people on mass-use public transportation.

The Ministry of Health must adjust policy from the perspective of the people. Instead of uniformly enforcing the four-head cap per table in restaurants and cafes, it must allow bigger groups in more spacious locations.

서울행정법원이 그제 학원·독서설·스터디카페 등 교실 밖 학습시설에 '방역패스'(접종증명·음성확인)를 의무화한 정부조치에 브레이크를 걸었다. 정부가 지난해 12월 6일부터 학습시설에 방역패스를 의무화하자 반발한 전국학부모단체연합 등이 보건복지장관을 상대로 제기한 가처분 신청을 법원이 받아들인 것이다. 백신 미접종자에게 불이익을 주는 것은 교육의 자유와 직업 선택의 자유 등 기본권을 침해하는 조치란 것이 법원의 판단 취지다.

법원 결정 이후 복지부가 항고키로 했지만, 1심 본안판결이 나올 때까지 상당기간 학습시설 방역패스 의무화 조치의 효력이 정지된다. 이에 따라 학습시설에서 확산 중인 청소년의 집단감염을 막기 위해선 밀집도 제한 등 별도대책이 시급해 보인다. 게다가 3월 1일로 예정된 18세 이하 청소년 방역패스 확대조치에도 영향을 줄 수 있는 만큼 정부는 대응책을 고민해야 한다.

법원의 이번 가처분 결정은 일반 학습시설에 국한된 것이므로 정부는 방역패스 무용론 등 확대해석이나 오해를 불식하는 노력을 병행해야 한다. 다만 앞으로가 문제다. 지난달 31일 식당·카페 등에 대한 방역패스 적용중단을 주장하는 가처분이 신청된 상태여서 유사한 결정이 나올 경우 파장이 더 커질 수 있기 때문이다. 만약 법원이 학습시설과 유사한 결정을 할 경우 정부의 방역패스는 무용지물이 될 가능성도 배제하기 어렵다.

정부는 자칫 잘못하면 방역에 대한 경각심이 무뎌지고, 방역의 대원칙이 흔들릴 수 있다는 점을 심각하게 인식해야 한다. 기존 방역대책이 행정편의주의적 관점에서 만들어지지 않았는지 되돌아봐야 한다. 일률적·획일적·정치적 방역에서 벗어나 모두가 수긍할 수 있는 과학적·합리적 방역으로 거듭나야 한다.

예컨대 당장 오는 10일부터 마트·백화점에 방역 패스를 의무화하기로 하자 불만이 터져나온다. 버스·지하철은 미접종자도 아무 제약 없이 이용하는데, 생필품을 사러 혼자 마트에 장 보러 가는 것도 차단하면 어쩌라는 것이냐는 호소다. 특히 임산부의 경우 약 90%가 미접종자여서 방역 지침의 합리적 조정이 필요해 보인다.

질병관리청은 방역지침 수용자인 국민 입장에서 국민이 수긍하고 따를 수 있는 '방역 2.0'을 계속 고민하고 정책을 정교하게 다듬어야 한다. 예컨대 가장 불만이 많이 제기되는 식당·카페 등 다중이용시설의 경우 획일적 인원제한을 넘어 면적기준 등 좀 더 과학적 방역지침을 내놓아야 한다.

감염병 전문가들은 전파력은 높지만 치명률이 상대적으로 낮은 코로나19의 오미크론 변이 바이러스가 다음 달 중 우세종이 되리라 전망한다. 이런 상황변화를 두루 반영해 방역지침을 계속 업그레이드해야 한다.
